Trump, President of the United States, et al. v. Casa, Inc., et al.(2025) – Nationwide Injunctions

Description

The U.S. Supreme Court held that Congress in Federal statutes does not authorize “nationwide” or “universal” injunctions that reach more broadly than is needed to provide relief to the parties to the case.  The ruling indicated that the court may award relief that incidentally benefits non-parties when necessary to provide complete relief to the plaintiff. The decision did not direct the intent to limit nationwide injunctions, the decision left open the possibility for litigants to seek universal relief.

  • Monitor litigation, noting that nationwide injunctions may be limited.
  • Review policies to ensure compliance with current federal rules in applicable jurisdictions.
  • Prepare to adapt practices as enforcement may vary regionally.
