Loper Bright Enterprises v. Raimondo (2024) - Agency Authority

Description

The U.S. Supreme Court decided that when a law is unclear, courts—not federal agencies—must decide what the law means under the Administrative Procedure Act (APA). In Loper Bright, the Court overturned the Chevron Deference Doctrine, which had previously required courts to accept agencies’ interpretations in cases of unclear or silent laws. This 2024 decision reduces how much courts defer to agencies, gives courts more power to review federal regulations, and could lead to more legal challenges to agency rules.

  • Review and update institutional compliance policies.
  • Participate in public comment periods on proposed rules.
  • Consult legal counsel on ambiguous regulations.
  • Document internal interpretations and compliance actions.
