Changes to the Approval Process for Changing Accrediting Agencies

 

Description 

The Department’s guidance is intended to help institutions understand and manage the process of selecting or changing an accrediting agency. Based on the Higher Education Act (HEA) and federal regulations, the guidance:

  • Confirms that institutions have discretion in choosing their accreditor.
  • Explains the criteria for demonstrating reasonable cause to change accreditors.
  • Recognizes the role of state authority in the process.
  • Outlines procedures and timelines for Departmental review.

 

The guidance also notes that if the Department does not act within 30 days of receiving a complete notification, approval may be considered automatically granted, provided no legal restrictions apply.

 

This guidance replaces the 2022 Biden administration guidance (GEN-22-10 and GEN-22-11), which had restricted the use of “reasonable cause” and prescribed detailed steps for changing accreditors. The new guidance reflects a shift in interpretation, giving institutions greater flexibility in making accreditor changes.

Action to be taken

Based on the Department’s guidance, institutions should take the following actions if they wish to change accreditors:

  • Evaluate Accreditor Needs
    • Assess whether a new or additional accreditor aligns with institutional goals and program requirements.
  • Document Reasonable Cause
    • Prepare justification demonstrating reasonable cause for the change.
  • Engage State Authorities
    • Confirm compliance with any state requirements or approvals.
  • Submit Notification to DOE
    • Provide a complete submission with rationale and supporting documentation.
  • Monitor Review Timeline
    • Track the 30-day Department review period; note that approval may be automatic if no action is taken and no legal restrictions exist.
  • Maintain Records
    • Keep copies of all notifications, communications, and approvals for audit and compliance purposes.
  • Communicate Internally
    • Inform leadership, compliance, and program staff about the change and any necessary procedural updates.
